Abstract
Resumo: O artigo olha de perto a Constituição Portuguesa, pelo prisma das sete revisões constitucionais que tiveram lugar desde 1976. Torna-se fácil verificar que todas as revisões que tiveram lugar foram induzidas, na maior parte dos casos directamente, por processos associados com a integração europeia em curso. Alguns deles fizeram-no em “momentos constitucionais” antecipatórios que tornaram possível a nossa entrada na Comunidade Europeia. A maioria seguiu os imperativos dos sucessivos Tratados. Um caso atípico foi o ligado à criação de um Tribunal Penal Internacional. O artigo liga um ao outro estes dois processos paralelos – o das revisões constitucionais portuguesas e o da integração europeia – e encara o estabelecimento desta ligação como um reflexo de uma nova comunidade política, mais abrangente, imaginada pelas elites políticas portuguesas.
Abstract: The Process of European Integration and the Portuguese Constitution The paper takes a close look at the Portuguese Constitution, through the prism of the seven revisions which it underwent since 1976. It is easy to note that all of the revisions which took place were induced, in most cases directly, by processes associated by the ongoing European integration. Some did so in anticipatory “constitutional moments” which rendered possible our entry into the European Community. Most followed the successive Treaty imperatives. An atypical case was linked to the creation of the International Criminal Court. The paper connects these two parallel processes – that of Portuguese constitutional revisions and that of European integration – to each other and sees the establishment of this link as a reflection of a wider and new political community imagined by Portuguese political elites.
