Abstract

The study analyzed the CJEU’s judgment to verify whether the decision converges with the Sustainable Development Goals and helps achieve social rights. As for the methodology, it’s applied nature research; the research problem was approached from a qualitative perspective and with an explanatory objective; bibliographical review, documental research, and analysis of the CJEU's case were the technical research instruments used. The investigation result shows that the CJEU has resorted to the idea of sustainable development; however, the Court’s decision was materialized in a scenario marked by controversy. Therefore, the leading case regarding nuclear energy and sustainability can be considered controversial. It was observed that literature, rulings, and judicial decisions on sustainable development need to be better explored. Te work contributes to advancing the analysis of judgments and approaching divergent and often distant themes. Moreover, the systematization presented can serve as a reflection guide for jurists and policymakers.
