Silogismo e marcas linguísticas a serviço da argumentação na prática jurídica

This article aims at analyzing, on the one hand, some argumentative strategies in a legal document called detailed term from the perspective of Textual Linguistics, and on the other, at identifying the syllogism used by the author in its argumentation in order to defend his thesis, using concepts from the Formal Logic. To attend this objective, firstly, the metatextual component is described. Secondly, the legal syllogism used by the author, known as hypothetical syllogism, with propositions, implicitly composed in the exceptive way, is identified. Thirdly, some argumentative operators, modal operators and lexical units are portrayed. All of these elements support the thesis. To summarize, this study in this legal document provides some evidence on the importance of syllogistic models and linguistic markers to characterize the argumentative strategies in some social practices.

Este artigo visa, por um lado, a analisar algumas estratégias argumentativas presentes em uma peça do procedimento sumaríssimo denominada termo circunstanciado sob a perspectiva teórica da Linguística Textual e, por outro, a verificar o silogismo utilizado pelo autor em defesa da tese apresentada, utilizando conceitos da lógica formal. Para tal objetivo, descreve-se, primeiramente, o componente metatextual e, em seguida, identifica-se o silogismo hipotético que predomina no documento, com proposições implicitamente compostas, na forma exceptiva. Num terceiro momento, os elementos linguísticos são analisados. Foram identificados operadores argumentativos, operadores modais e também elementos lexicais que suportam a tese. Para concluir, pode-se pressupor que este estudo pode vir a mostrar que os modelos silogísticos e de alguns marcadores linguísticos para a caracterização de algumas estratégias argumentativas relevantes em algumas práticas sociais.
