Abstract
Este artigo analisa a noção de ataque constante do artigo 49.º do I PA às CG e a sua adequabilidade em relação às ciberoperações militares. A metodologia assentou na revisão do estado de arte, no recurso às leis e às regras jurídicas aplicáveis, à jurisprudência, à doutrina e à soft law. Foram analisadas as diferentes correntes doutrinárias (Schmitt, Dörmann e Melzer) e conclui-se que o conceito de hostilidade, embora não seja perfeito, todavia, é o que oferece mais garantias para proteger os civis, população civil e objetos civis.

Abstract: This article focuses on the concept of attack enshrined in article 49.º of the I AP to the GC and its suitability for Military Cyber Operations. The methodology used was the revision of the state-of-the-art, law and rules, case law, doctrine, and soft law. Several scholars were considered (Schmitt, Dörmann and Melzer) to conclude that the concept of hostilities, even not being perfect, is the one which is the most suitable for the protection of the civilian population, civilians, and civilian objects.
