Abstract

The legal persecution of homosexuals in Portugal presents as much continuities as breaks between the four political regimes that have folowed one another in the nineteenth- and twentieth-centuries, Constitutional Monarchy (until 1910), Democratic republic (1910-1026), Estado Novo fascust dictatorship (1926-1974) and Democracy (from 1974), until it was completely decriminalized by the 1982 Penal Code. The criminalization of homosexuality went along its pathologization, and they overlap from the Penal Code of 1852, thoughout the 1912 law and the implementation of security measures and penal colonies specifically targeting homosexuals, to the typifying of homosexual dangerousness in the 1936 Decree.
